Part IV · Right to Constitutional Remedies

Article 37 Application of the principles contained in this Part.

In force

This article sets the legal force of the directive principles. Courts cannot enforce them. Yet the principles are fundamental in the governance of the country, and the State must apply them in making laws. They guide; they do not bind like fundamental rights. This balance between ideal and law runs through Part IV.

  1. The provisions contained in this Part shall not be enforceable by any court, but the principles therein laid down are nevertheless fundamental in the governance of the country and it shall be the duty of the State to apply these principles in making laws.
